Promoting good nutrition in patient with dementia Research Paper
Promoting good nutrition in patient with dementia - Research Paper Example Based on the causes of dementia, Alzheimerââ¬â¢s disease is the major cause, but secondary causes also have a role to play. This includes secondary brain conditions and injury to the brain substance secondary to trauma. Alzheimerââ¬â¢s disease is a degenerative brain condition affecting memory and cognitive brain functions, and is the commonest form of dementia in people over the age of 65. Vascular dementia results from cerebrovascular or cardiovascular problems which often result in strokes. Minor but important causes of dementia include HIV diseases, Huntingtonââ¬â¢s disease and Creutzfeldt-Jakob disease. Dementia is a condition whose principal prevalence is in old people over 65 years, but children and middle aged adults may suffer from dementia. Trauma, brain tumours, heart conditions, lung conditions, poisoning and some terminal infections may lead to dementia in this group. Some inherited disorders like glycogen storage diseases and mitochondrial abnormalities are specific for children, causing dementia. Whatever age group affected, dementia is a serious condition that leads to progressive memory loss and degenerative cognitive functions. Treatment will never reverse or stop the condition, but instead the treatment reduces the symptoms, thereby slowing down the disease progression. Apart from symptom alleviation, adequate rest, nutrition and hydration are very important as they reduce morbidity and mortality. In terminal dementia, the patients are unable to cater for themselves completely which calls for the input of the caregiver in providing optimal nutrition and in the correct proportion. In dementia, there is degenerative brain loss due to loss of neurons. Dementia is associated with malnutrition due to the feeding difficulties in people who suffer from the condition. Impaired cognitive functions lead to a deficit in the short-term memory making the patient forget simple tasks like feeding. The patient may also become easily distracted, thereby

Organic Chemistry (Methamphetamine) Essay Example for Free
Organic Chemistry (Methamphetamine) Essay Methamphetamine was first synthesized from ephedrine in Japan in 1893 by chemist Nagai Nagayoshi. In 1919, crystallized methamphetamine was synthesized by Akira Ogata via reduction of ephedrine using red phosphorus and iodine. Synthesis is relatively simple, but entails risk with flammable and corrosive chemicals, particularly the solvents used in extraction and purification; therefore, illicit production is often discovered by fires and explosions caused by the improper handling of volatile or flammable solvents. Most of the necessary chemicals are readily available in household products or over-the-counter cold or allergy medicines. When illicitly produced, methamphetamine is commonly made by the reduction of ephedrine or pseudoephedrine. The maximum conversion rate for ephedrine and pseudoephedrine is 92%, although typically, illicit methamphetamine laboratories convert at a rate of 50% to 75%. Methamphetamine has been reported to occur naturally in Acacia berlandieri, and possibly Acacia rigidula, trees that grow in West Texas. Methamphetamine and regular amphetamine were long thought to be strictly human-synthesized, but Acacia trees contain these and numerous other psychoactive compounds (e.g., mescaline, nicotine, dimethyltryptamine), and the related compound à ²-phenethylamine is known to occur from numerous Acacia species. Diagrams Health Concerns Physical effects can include anorexia, hyperactivity, dilated pupils, flushing, restlessness, dry mouth, headache, tachycardia, bradycardia, tachypnea, hypertension, hypotension, hyperthermia, diaphoresis, diarrhea, constipation, blurred vision, dizziness, twitching, insomnia, numbness, palpitations, arrhythmias, tremors, dry and/or itchy skin, acne, pallor, and with chronic and/or high doses, convulsions, heart attack, stroke, and death can occur. Psychological effects can include euphoria, anxiety, increased libido, alertness, concentration, energy, self-esteem, self-confidence, sociability, irritability, aggression, psychosomatic disorders, psychomotor agitation, grandiosity, hallucinations, excessive feelings of power and invincibility, repetitive and obsessive behaviors, paranoia, and with chronic and/or high doses, amphetamine psychosis can occur. Methamphetamine use has a high association with depression and suicide as well as serious heart disease, amphetamine psychosis, anxiety and violent behaviours. Methamphetamine also has a very high addiction risk. Methamphetamine also is neurotoxic and is associated with an increased risk of parkinsons disease. Methamphetamine abuse can cause neurotoxicity which is believed to be responsible for causing persisting cognitive deficits, such as memory, impaired attention and executive function. Over 20 percent of people addicted to methamphetamine develop a long-lasting psychosis resembling schizophrenia after stopping methamphetamine which persists for longer than 6 months and is often treatment resistant. Meth labs can also be fatal seeing as they often blow up. This is usually due to amateur chemists operating them. They can also give off deadly fumes. Where It Is Commonly Found Methamphetamine is FDA approved for use in children and adults under the trademark name Desoxyn. A generic version became available in April, 2010. It is prescribed as a treatment for ADHD and exogenous obesity, as well as off-label for the treatment of narcolepsy and treatment-resistant depression. Physical Properties Formula C10H15N Mol. Mass 149.233g/mol Half-Life 9-12 hours Metabolism hepatic IUPAC Name N-methyl-1-phenylpropan-2-amine Structure Related To Function The structure of this molecule is very much related itââ¬â¢s function. It closely mimics another molecule which stimulates the brain. This molecule fits the receptor site and therefore acts as a stimulant. Functional Groups Methyl Amino Aromatic (Phenyl)

John Bergers Another Way of Telling Essay example -- essays research
In John Bergerââ¬â¢s essay ââ¬Å"Another Way of Telling,â⬠Berger argues that photographs contain a ââ¬Å"third meaning.â⬠Berger claims that the third meaning is personal and relies almost completely on the individual viewer. As a result, no photograph can convey the same message to any two people and no two photographs can convey the same message to any one person. Here, the validity of Bergerââ¬â¢s assumption crumbles. All photographs communicate one absolute truth. à à à à à Berger states, ââ¬Å"All subjectivity is treated as privateâ⬠(100). Yet, claiming that anything subjective within a photograph, its past and future, is personal only supports an absolute truth. The truth, however, is beyond the viewerââ¬â¢s conscious interpretation and the photograph becomes ambiguous. Berger becomes mislead when he compares an individualââ¬â¢s opinion of the past or future of a photograph to the actual truth of the photograph, thus surfaces ââ¬Å"ambiguity.â⬠Even Berger agrees that ambiguity is the result of the viewerââ¬â¢s personal experiences and psychology, but he ignores what the viewer cannot see. When discussing the ambiguity of the photograph of the horse and man, page 85, Berger can only guess as to why the photograph was taken and to what the meaning is. Berger describes this process as, ââ¬Å" . . . a game of inventing meaningsâ⬠(86). Here, Berger admits to creating meanings, based on his life experiences and his personal psychology. Obviously, if one places his or her own, fictitious meanings unt...

A Deconstructionist Critique of Chopinââ¬â¢s The Awakening Essay -- Chopin
A Deconstructionist Critique of Chopinââ¬â¢s The Awakening The multiplicity of meanings and (re)interpretations informing critical studies of The Awakening reveal a novel ripe for deconstructionist critique. Just as Chopin evokes an image of the sea as symbolic of Ednaââ¬â¢s shifting consciousness (ââ¬Å"never ceasing, whispering, clamoring, murmuring, inviting the soul to wander in abysses of solitude,â⬠138), likewise the deconstructionist reading of a text emphasizes fluidity over structure: ââ¬Å"A text consists of words inscribed in and inextricable from the myriad discourses that inform it; from the point of view of deconstruction, the boundaries between any given text and that larger text we call language are always shifting,â⬠(297). From this perspective, the reader/critic opens the doors of interpretation instead of narrowing their focus to any singular, exclusionary reading, and exposes the deconstruction at work within the text itself. Whether defined as feminist martyr, metaphorical lesbian, the triumphant image of social transcendence or a broken bird ââ¬Å"beating the air above . . . circlin...

Victoria Secret in Turkey
The Middle East consists of several countries in West Asia. Armenia, Azerbaijan, Bahrain, Gaza Strip, Georgia, Iran, Iraq, Israel, Jordan, Kuwait, Lebanon, Oman, Qatar, Saudi Arabia, Syria, Turkey, United Arab Emirates, West Bank, and Gaza, are all the 19 countries that are categorized as the Middle East. The term Middle East is considered to be a Eurocentric term and is used as a synonym for the Near East. Since the Middle East extends over so many countries, there are major economic, cultural, and religious differences. Some of the countries in the Middle East are extremely wealthy oil nations like Saudi Arabia, Qatar, and United Arab Emirates, that generate large amount of revenue and are on the top list of the worldââ¬â¢s wealthiest nations based on income per capita. And then there are some really poor nations, like Gaza and Yemen, which are characterized by unrest and war. The Middle East also varies a lot when it comes to culture and religion. Islam is the biggest religion i n the Middle East and many of the countries have really strict religious rules, with little freedom for women. But there are also countries where Judaism and Christianity are represented, and women have equal or almost equal rights as men. Victoriaââ¬â¢s Secret was founded in 1977, in San Francisco by Roy Raymond. It started with three stores and a mail-order catalog. In 1982, after only five years of operations, Raymond sold the company to Leslie Wexner for $4 million. During the 80ââ¬â¢s Victoriaââ¬â¢s Secret rapidly expanded into U. S malls. By the early 90ââ¬â¢s Victoriaââ¬â¢s Secret had become the largest American lingerie retailer, topping one billion dollars. There are approximately 1,000 Victoriaââ¬â¢s secret lingerie stores and 100 independent Victoriaââ¬â¢s Secret Beauty stores in the U. S. We sell a range of brassieres, panties, hosiery, cosmetics, sleepwear, and other products. In 1995 Victoriaââ¬â¢s Secret had their first fashion show, which today has become a huge hit. The show features some of the world's leading fashion models such as current Victoria's Secret Angels Adriana Lima, Alessandra Ambrosio, and Miranda Kerr. Because of the huge differences in economy, culture, and religion, we at Victoriaââ¬â¢s Secret decided to focus on one country at a time.We decided that it would be the best opportunity to open our store in Turkey. Turkey has the largest economy in the Middle East based on nominal gross domestic product (GDP) and the cultural and religious barriers are not as dominant as in some of the other Middle Eastern countries. Turkey also has a huge market for tourism. Market Turkey has a large population with 71 million people. They have generally a young population, with 61% of the people being younger than the age of 35. Turkeyââ¬â¢s average gross national product (GNP) per capita is $7,500.About 71% of the population lives in the urban areas. Istanbul is Turkeyââ¬â¢s largest city with about 12 million peo ple, and Ankara, the capital, has about 5 million people. Turkey is located in Southeastern Europe and Southwestern Asia, bordering the Black Sea and the Aegean Sea. Turkeyââ¬â¢s location gives them an excellent base for economic activities throughout the region. Turkey has a budget revenue of $176. 8 billion and a budget expenditure of $189. 2 billion. Turkey is running a budget deficit of 1. 6% of real GDP.This budget deficit, together with uncertainty related to the monetary policy-making, and political disorder in Turkeyââ¬â¢s neighbor countries, makes the Turkish economy vulnerable to destabilization shifts in investorsââ¬â¢ confidence. Turkey has a young and well-educated population, but 10. 3% of the Turkish population is unemployed. The labor force is 27. 43 millions, where 25. 5% works within the agricultural sector, 26. 2% works in industries, and 48. 4% works within the service sector. Young people between the age of 15 and 24, 25% are unemployed. Women are still an untapped labor force in Turkey.Researchers say that about half of all Turkish women enter the labor market at some point in their lives, but most end up quitting because of family obligations or poor working conditions. We feel that this is a great opportunity for our company, because our target market is women. We will strive to create ideal working conditions for all of our employees so they feel that they want to keep working for Victoriaââ¬â¢s Secret. Economic and Political Climate We at Victoriaââ¬â¢s Secret have been attracted to the Turkish market by the countryââ¬â¢s rapidly expanding economy, political and economic stability, and the possibility of European Union membership.Since Turkey is an associated member of the EU, it had to adopt many directives, regulations, and laws that are required by the EU. Turkey is going through changes, to strengthen its democracy and integrate its economy into the global market. The changes that Turkey is going through are goin g to be beneficial to us, because it will make Turkey an easier market to enter and to do business in. It is also crucial for us that Turkeyââ¬â¢s government are become a more stable government. It would be hard for Victoriaââ¬â¢s Secret to thrive when the government is unstable and there are rapid and drastic policy changes. For a business to survive in a foreign country, it is crucial that there is a government that can maintain itself in power and whose fiscal, monetary, and political policy are predictable. Turkey has an open market economy, with a blend of both modern and traditional industries. Turkeyââ¬â¢s industry and service sector are becoming the major drivers of the Turkish economy. Their private sector is becoming increasingly important, as state involvement is reducing. The traditional textiles and clothing sectors, still account for one-third of industrial employment in Turkey.During 2011, the United Sates exported to Turkey for $15 billion, this is 34% increa se from 2010. Foreign direct investment (FDI) has in the recent years been attracted to Turkey because of their market reforms, strong growth and economic and political stability. The U. S. has officially invested about $6-7 billion in Turkey, a number that is understated because U. S. companies have invested through third countries. There are no restrictions over the export of goods from Turkey. Exports are exempt from the value added tax (VAT), duties and transaction taxes. Goods manufactured in Turkey have a duty free access to the EU.There are also no import restrictions over goods imported to Turkey, with the exclusion of some restraints of very minor character. For imports that are imported to Turkey from countries other than European Union, customs duties and charges are applicable in agreement with the requirements of the customs union. Regardless of origin of goods, whether from the EU or a non-EU country, VAT is at a rate 18% (1% or 8% for certain basic goods). Good and se rvices imported into the country, industrial, commercial, agricultural goods and services, and deliveries of goods and services caused by other activities, are all subject to VAT.The guidelines involving to the remittance of foreign capital and dividends out of the country are set out in Law No. 1567. According to these regulations, foreign investors have the same privileges and responsibilities as Turkish investors. The regulations also guarantee the transfer of profits, fees, and royalties and the repatriation of capital in the case of a liquidation or sale. For foreign businesses to enter into Turkey there is no longer a minimum amount of capital requirement, due to Turkeyââ¬â¢s new Foreign Direct Investment Law. ââ¬Å"It is no longer obligatory to bring a minimum of $50,000 in share capital. As long as the form of company is included in the Turkish Commercial Code, it is your own choice on what company you want to establish. ââ¬Å"It is no longer obligatory to establish eit her a limited liability company or joint stock company. â⬠In 2006, Turkey cut its corporate income tax rate from 30% to 20% making it one of the most competitive rates in the OECD. These corporate income tax rates, has mad Turkey an attractive business environment that presents advantages and potential opportunities for business wishing to enter the market. Culture and InfluencesCulture is defined as ââ¬Å"the sum of the total of the beliefs, rules, techniques, institutions, and artifacts that characterize human populations. â⬠Societies are composed of its people and their culture; it is therefore difficult to talk about one aspect without referring to the other. Sociocultural has become the term that is used among businesspeople when talking about cultures and societies. For Victoriaââ¬â¢s Secret to be successful in opening a store in Turkey it is crucial for us to realize that there are a culture differences from that of our own, as well as learning the characteris tics of the culture so that we can adapt to them.Since culture is so broad, a listing of its components may ease the analysis of the sociocultural viewpoint. These components include: aesthetics, attitudes and beliefs, religion, material culture, language, societal organization, education, legal characteristics, and political structures. The component that apply for Victoriaââ¬â¢s Secret launch in Turkey is in particular religion, but aesthetics, and societal organization can also have an impact.Religion is an important component of culture and holds responsibility for many attitudes and beliefs the people have. In Turkey, the people practices the religion Islam and the population consist of 99. 8% Muslims, mostly Sunni. The Muslims follows the Koran, which is the collection of Allahââ¬â¢s revelations to Muhammad, and is said to be the messenger of God. Following the Koran means freedom, and it is said to bring happiness for the Muslim to follow Gods word. For all Muslims the basic spiritual duties consist of the ive pillars of faith: accepting the confession of faith; making the five daily prayers while facing Mecca; giving charity; fasting during the daylight hours of Ramadan, a 29- or 30-day month in Islamââ¬â¢s lunar calendar; making a pilgrimage to Mecca at least once in a personââ¬â¢s lifetime. The Turkish state is becoming more and more modernized, and so is also its religion. Turkey seeks to modernize Islam because they believe that it might hinder their development in becoming a more globalized and modern country. We believe that Turkey is a good place to open our next store in the Middle East because they are open for this kind of new businesses.Aesthetics refers to a cultureââ¬â¢s sense of beauty and good taste. As the Turkish people are getting more modernized, they will also get more influenced by the rest of the world. We believe that the fashion trends that are popular in the U. S. will become popular in Turkey as well, and that V ictoriaââ¬â¢s Secret lingerie can become part of the Turkish womenââ¬â¢s daily life. Societal organization ââ¬Å"is the patterned arrangement of relationships defining and regulation the manner by which its members interface with one another. The women in Turkey donââ¬â¢t have the same status as women in the U. S. , and the men and womenââ¬â¢s roles may vary a lot. This might cause a problem when launching Victoriaââ¬â¢s Secret in Turkey, nevertheless, we believe that the Turkish women, as they get more influence by the fashion trends in rest of the world, they will create a desire to buy our products. Victoriaââ¬â¢s Secret is facing some sociocultural challenges when launching our business in Turkey, and we will have to give our customers some time to adapt to our products. However, when considering Turkey is development toward a more modern and global nation we have a bright outlook for the future, and believe those challenges will be exciting to tackle. Competit ion ââ¬Å"International strategy is concerned with the way firms make fundamental choices about developing scare resources internationally. â⬠It is going to be crucial for Victoriaââ¬â¢s Secret to implement an international strategy because it involves decisions that deal with what products or services to offer, which markets to enter, and how to compete. It also deals with all the various functions in the organization, such as marketing and production. The goal with an international strategy is to create competitive advantage, which means that the business has achieved and maintained a unique and valuable position both globally and within a nation. To create sustainable competitive advantage it is important that a product or service creates value for consumers and for which customers are willing to pay for, are rare, are difficult to imitate or substitute, and are organized in a way that allows the company to fully exploit and capture the value of the product or service.Th ere are numerous lingerie companies in Turkey that can act as competitors when launching Victoriaââ¬â¢s Secret in the country. The Turkish economy is growing and the local companies are developing great skills when it comes to adapt to customers demand, which results in companies that are becoming stronger when competing in the global market. However, the main reason why Victoriaââ¬â¢s Secret has become so successful is because we have been able to create products and services that meet the criteria for a sustainable competitive advantage. Therefore we believe that we will be able to successfully compete against the Turkish lingerie companies.Turkish is the predominant language in Turkey, spoken by 90% of the population. Minority languages include Kurdish, which is spoken by 6% of the population, although this isn't recognized as an official language. 1. 2% of the Turkish population speaks Arabic but most of those speakers are bilingual and speak Turkish as well. Because we wi ll compete at a local level we believe that it will be important to communicate in Turkish. We will make sure that we have employees that are fluent in Turkish to be a part of our marketing and business team in order to establish a local presence with our products.Because verbal communication is more dominant than written expression in business in Turkey we will focus much of our advertising through media such as radio and TV. Since most of population is Muslim we have to take this into consideration when creating our advertising campaigns. Something that could be a challenge for us is the variable prices many stores and competitors have. This cultural difference where everything is negotiable have to be considered when entering Turkey. A wide range of shops has no prices listed. Customers simply have to ask the price of everything and the sales person will have the right answer.Even luxury shops selling diamond jewelry are open to negotiation. We have chosen not to adjust to this c ultural difference. It does not go well with our business model and we believe that customers will be able to adjust to Victoriaââ¬â¢s Secret stricter price listings. But, it is still something to be aware of when training our employees that will be working in our stores. Special offers and other sales or marketing tricks are common in the Turkish business environment. The ââ¬Å"buy one, get one freeâ⬠offer can be seen in most retail stores in Turkey. This is something that we will use and take advantage of.We will use the same strategies as we have in the US. Making special offers for customers if they buy more than one of selected items. Seasonal offers will also be implemented. Victoriaââ¬â¢s Secret in the Middle East We want to make Victory Secret the most known lingerie brand in the world. By expanding with a third store in the Middle East, and more specific in Turkey, we are certain that we will be able to reach this goal. The S.E.C. and the Freedom of Information Act
The S.E.C. and the Freedom of Information Act Abstract This report highlights three different business statutes that currently function in the business communications environment of the United States: the Electronic Communications Privacy Act, the Health Insurance Portability and Accountability Act (HIPPA), and the Freedom of Information Act. A recent case concerning the application of the Freedom of Information Act and public disclosure in the activities of the Securities and Exchange Commission warrants closer analysis. This report will analyze the impact that the Freedom of Information Act has upon the financial regulator and what impact recently passed financial reform legislation will have on the public. The Electronic Communications Privacy Act (ECPA) protects electronic communications in the business environment such as emails, text messages and wireless device transmissions, and ensures that these messages cannot be captured or screened without the express consent of the parties in question (Hunsinger 2010). However, some caveats apply in the business context. If there exists a need to protect business property, or a ââ¬Å"valid business purposeâ⬠necessitating the acquisition of employee emails, an employer may do so under this act with the permission of the employee in question (Hunsinger 2010). Most compa nies achieve this end through via a blanket company policy which all employees sign (Hunsinger 2010). As a general rule, employees cannot expect the same ââ¬Å"reasonable expectation of privacyâ⬠on a server owned by their employee as they can on the server that operates their personal email (Hunsinger 2010). The Health Insurance Portability and Accountability Act (HIPAA) covers employee privacy in the realm of health information (Sullivan 2004). This act regulates, oversees and protects the security of electronic health data such as medical records and establishes national standards which employers abide by for employee health insurance plans (Sullivan 2004).Advertising Looking for report on business economics? Get your first paper with 15% OFF Learn More The actââ¬â¢s main purpose and challenge remains to balance the needs of employers to provide economically viable health insurance coverage for their employees agains t the needs of employees, namely, so that employee health information remains secure and cannot be used against them in a discriminatory manner (Sullivan 2004). The Freedom of Information Act became law in 1966 and protects the right of the citizens of the United States to ââ¬Å"request access to federal agency records or informationâ⬠(Henry 2003). The act was meant to balance the needs of the government to maintain some level of secrecy and privacy in its information gathering and storage against the rights of the American public to request and receive accountability from its leaders. Each agency of the United States government must comply with written disclosure requests except in cases where the information requested is protected by exemption or exclusion (Henry 2003). The Freedom of Information Act applies only to federal bodies; each state retains its own statute that manages public requests for state and local government information (Henry 2003). The remainder of this r eport studies two newspaper articles that reported a new financial regulation provision that came into law in 2010. Under this law, according to Sorkin (2010), the federal financial regulatory body the Securities and Exchange Commission (SEC) gained an exemption from public disclosure of requests for information filed under the Freedom of Information Act (Sorkin 2010). The details of the exemptions include ââ¬Å"surveillance, risk assessments, or other regulatory and oversight activitiesâ⬠(Sorkin 2010). John Nester, a spokesperson for the SEC, explained that ââ¬Å"the new provision applies to information obtained through examinations or derived from that information (Prial 2010). Nester intimated that the SECââ¬â¢s expansion of its existing modes of surveillance and risk assessment effortsâ⬠have been undertaken to affect ââ¬Å"more sophisticated and effective Wall Street oversightâ⬠(Prial 2010). In order to achieve this, the SEC argues, it requires the ââ¬Å "ability to obtain documents and other information from brokers, investment advisers and other registrants,â⬠therefore this new provision gives the SEC more access during their examinations and ensures that brokers and financial investment advisers and other registrants can no longer refuse to comply with any SEC requests for documents under previous confidentiality expectations (Prial 2010). The impact of this new provision, critics argue, will essentially result in a complete block to all transparency efforts on behalf of the American public in the already shadowy world of high finance (Prial 2010). Since the SEC is a regulatory body, the so-called ââ¬Å"surveillance, risk assessments, or other regulatory and oversight activitiesâ⬠will render nearly every document by the SEC unobtainable (Sorkin 2010). Federal agencies and members of Congress may continue to request information from the SEC however the public has been officially shut out (Prial 2010).Advertising We will write a custom report sample on The S.E.C. and the Freedom of Information Act specifically for you for only $16.05 $11/page Learn More In the business context, this new provision has significant ramifications for transparency goals in the wake of the recession, not to mention the continued efforts of the media to maintain public accountability in the financial world. The recent Bernie Madoff Ponzi scheme provides the most salient example of how this provision may provide an obstacle for corporate governance and communication transparency objectives on behalf of both business and the public (Prial 2010). News media outlets such as FOX Business Network regularly employ the Freedom of Information Act to affect oversight of the SEC itself on behalf of the American public and investors (Prial 2010). FOX Business Network took legal action against the SEC in the spring of 2009 on account of the federal bodyââ¬â¢s refusal to hand over documents pertaining to the failed SEC investigations into ââ¬Å"alleged investment frauds being perpetrated by Madoff and R. Allen Stanfordâ⬠(Prial 2010). Upon the arrest of Madoff and Stanford, it came to light through documents acquired under the Freedom of Information Act, that the SEC had carried out ââ¬Å"investigations into both men prior to their arrests but failed to uncover their alleged fraudsâ⬠(Prial 2010). Similarly, the Freedom of Information Act was employed on behalf of the public following the AIG bailout in 2009 (Prial 2010). With this new provision, critics argue that the SEC will not only wield carte blanche but their mistakes will escape notice, which may lead to more catastrophic frauds such as the Madoff scandal (Prial 2010). According to Prial (2010) should the interpretation of this new provision stand up in court, critics predict that ââ¬Å"the next time there is a Bernie Madoff failure the American public will not be able to obtain the SEC documents that describe t he failureâ⬠(Prial 2010). Observers anticipate that members of the media and media networks will likely launch a legal challenge countering the SECââ¬â¢s interpretation and demanding that the provision be rescinded in light of possible abuse by the SEC (Prial 2010). According to Prial (2010) ââ¬Å"the backroom dealâ⬠¦was cut between Congress and the SEC to keep the SECââ¬â¢s failures secret. The only losers here are the American publicâ⬠(Prial 2010). ISM uses innovative selling approaches and constantly enhances its innovation capabilities to produce successful products with superior designs, features and quality. As an IP developer, ISM controls its brands, designs, technologies and concepts. ISM operates a wide point-of-sales network of more than 1 1 93 outlets in more than 369 cities across 31 countries in Asia, Oceania, Africa, the Middle East, Europe and North America (ISM 2012). The ISM business consists of 4 focuses which together reflect the brands holistic approach to healthy lifestyle. 3. Macro-environment Analysis Macro-environmental analysis is the initial stage in comprehensive strategic planning. The purpose of the analysis involves the study of current and potential change and the assessment of the impact of changes on the organization (Ginger and Duncan 1990). . Optical Singapore government offers loans, grants, tax incentives and Nan-financial assistance to help organizations grow their business. SPRING Singapore provides funding such as the Customer-Centric Initiative to support projects undertaken by organizations in the healthcare sector to improve customer experience and benchmark themselves against industry standards. ISM has achieved significantly la rge amount of government development grant as shown in Figure 1 (refer to Appendix 9. 1). 3. Economics The global macroeconomic conditions have stabilized in recent months against the backdrop of improved financial market conditions, and the outlook for Singapore economy remains positive. According to Singapore Department of Statistics (2013), Singapore has grown by 1. 3 per cent in 201 2 and real GAP growth in 2013 is expected to be 1 to 3 per cent. With the global economy continuing to show affirmative signs of improvements, we hence see potential in the group to rake up more sales going forward, given its huge outwork of outlets. 3. Social As Singapore continues to grow and develop, maintaining the quality of life has become increasingly important. Healthcare products are no longer deemed as a luxury good but a necessity, as society trends towards a more sophisticated and healthy lifestyle. With higher population densities and rising expectations of individuals well-beings, the l ifestyle needs of a more diverse society will be a key challenge as well as an opportunity for ISM. With an increasing ageing population in many societies, ISM can consider how they can better cater to the lifestyle needs of this particular group. 3. Technological The new competitive landscape, driven by the technological revolution is moving towards an increasing focus on innovation, both in technology and new products or services. Being the global leader in healthy lifestyle products, ISM is in the forefront of innovation and the development of a wide range of products to bring the greatest health benefits to consumers. In order to stay competitive, companies are required to use the latest technology in product innovation, continue to develop new technology, actively participate in global markets, and structure themselves to gain advantage in these markets (Hit, Keats and Demark 1998). Furthermore, new technology is allowing firms to customize products to consumers more quickly and economically in terms of production output and cost reduction activities. 3. Relating Key drivers for change with Opportunities and Threats A PASTEL analysis of the macro-environment enables organizations to anticipate opportunities, reveal threats, and carefully develop responses to change (Johnson, Whetting and Schools 201 1). It is important to analyses how the factors in the framework are changing and how they are inter-connected. The technology developments in ISM may affect the social factor such as nonusers lifestyle by introducing more leisure. For a Health and Lifestyle industry, the two most important key drivers for change are social and technological changes. Societal change such as emphasis on overall well- being for longer life expectancy may drive the potential for producing a more comprehensive range of healthy lifestyle products. Similarly, major technological advancements may have a positive impact on Isms research and development (R) activities. An example is ISM massage chairs which are designed in combination with the convenience of the mobile app technology, the ISM divine app (ISM Bibb). On the contrary, a social change in consumers preference for more outdoor leisure activities may pose a threat to Isms future home healthy lifestyle products. Similarly, the global economic conditions may pose a threat to Isms business. The nature of ISM products make them more susceptible to reduced demand in times of economic downturn than other kinds of business as their products may not be considered as essential health products (ISM 2011). . Porters Five-Forces Porters five forces model helps managers recognize and analyses competitive forces within the industry, predict new prospects and challenges and prepare bible strategies against future challenges and threats (Hills and Jones 2008). 4. 1 Threat of new entry In the healthy lifestyle products industry, scale and experience, technology and high capital investment pose as high bar riers of entry. Established industry players enjoy optimal levels of economies of scale whereby there is large-scale production at a lowest cost. This deters new entrants as it would be expensive for them to compete due to higher unit costs. New entrants do not have the relevant experience and technology that existing competitors have that allows them to enjoy cost advantages through efficiency. In addition, regulations such as patent protection and trademarks safeguard the rights of established industry players and prevent new entrants from tapping on their knowledge and resources. The high barriers of entry lead to low threat of entry due to the high level of experience, cost savings and technology that existing large operators possess. Overall, the threat of entrants is relatively low. 4. Threat of Substitutes The presence of many key players in the international market evidently shows a relatively high substitution level in the healthy lifestyle products industry. Global consumer trends have observed that consumers have become more cautious about their spending habits; however, they are still willing to spend on items that are durable and value for money (Remuneration International 2012). This trend recognizes the threat of substitutes that results from the ratio of price to performance. Environmental-wise, there is an increasing demand for products that are more sustainable, environmentally friendly and ethically produced. Lastly, technological innovations have resulted in relatively low cost of transfer to another industry, such as the beauty industry, increasing the level of substitution. Overall level of substitutes to latherer lifestyle products is relatively high. 4. Bargaining power of buyers In this industry, quality, innovation, product diversity and the ratio of price to performance factors play vital roles. Economically, emphasis should be placed on understanding and considering the expectations and experiences of consumers before prices are adjusted, irrespective of the prevailing economic conditions (Analogy and Kari 2003). Technologically, the Internet age has resulted in a group of more informed consumers. Coupled with the wide variety of options in the market the power of buyers is enhanced as they are blew to switch to other brands easily. As buyers hold high bargaining power in the industry, differentiating ones brand through product innovation and development would prevent buyers from switching to other comparative substitutes easily. Overall, the bargaining power of buyers is high. 4. 4 Bargaining power of suppliers Economically, it is more cost effective to stay with the original supplier, especially during periods of high inflation rates. Due to goodwill, the original supplier would give companies longer credit terms, which would in turn increase the liquidity of companies in the business. Technology such as analytic, software tools and telecommunications are part of providing better information to existing industry players at a lower cost, and in product distribution. Besides, employees as suppliers for knowledge in the production process have placed operators in a vulnerable position. The high bargaining power of suppliers creates an unfavorable situation for industry players. ISM recognizes the importance of their employees and tries to reduce the bargaining power of suppliers by providing their employees with good welfare and benefits (ISM 2011 Overall, the power of suppliers in this industry is high. Competitive Rivalry This force identifies the level of competition posed by direct competitors whose target market is similar to the organization. Although political measures strive to reduce the presence of inferior quality and unsubstantiated products in the market, weaker economic conditions gave rise to more conservative spending, resulting in the growth of the bl ack market and stiffer competition within the industry. The extent of competitive rivalry has also increased due to current technological advancements that have quickened the growth rate of research and development in the industry. Even though the extent of competitive rivalry is high, existing operators should continue to innovate and build brand loyalty so as to compete and differentiate themselves in the industry. Otherwise, the extent of competitive rivalry in the healthcare lifestyle products industry is high. 4. Overall Five Forces Impact Using the five forces model to analyses the industry, it is increasingly favorable and attractive for potential and new industry players. 5. Resources and Competences Based on the resource-based view of strategy, the competitive advantage and superior performance of an organization is determined by its distinctive abilities (Heartfelt 1984). Strategic capabilities refer to the capabilities of an organization that contribute to its long-term survival which consists of its resources and competences (Mentors 2004), and when resources are deployed efficiently and effectively, it is said to be the firms core competences (Johnson, Whetting and Schools 2011 5. Financial Resource 2012 201 1 (AS million) Growth (%) Sales 602 554 Profit 87 69 +32 Cash and cash equivalents at beginning of year 193,813 73,157 Cash and cash equivalents at end of year 201 ,731 According to ISM (201 3), the Group has achieved its third consecutive year f record profit despite a tough economic environment. Isms ability to manage its cash flow has been reflected in the increased of cash and cash equivalents at end of both 2011 and 2012. For its balance sheet, it was evident that ISM has been improving its cash position and paring down its borrowings consistently, due to its strong positive operating cash flows over the years. They had done well in building a strong balance sheet with a net cash position of SASS million (ISM 2013), and showed superior management in its cash flows. 5. Inhuman Resource Johnson, Whetting and Schools (201 1) propose that the efficiency and effectiveness of the people in an organization depend not just on their existence, but on the relationship and cooperation between customers, partners or suppliers. In an attempt to build relationships across valuable networks, ISM signed a cooperation agreement with LEG Electronics Inc to enlarge its presence and market share in South Korea (ISM 2007). The Group has also gone into several partnerships (Figure 2; refer to Appendix 9. 2) whereby ISM can leverage on their nationwide specialty outlets across numerous states. Brand is always foremost in the company and consumers minds; hence, ISM ensures that everyone gets involved to ensure consistency In customers experience with the brand. It achieves this by implementing continuous improvement to keep the skills of its staff updated (Tem portal 2006). . Intangible Resource Hall (1992) argued that a companys reputation is perceived as one of the most significant resources which make the most important contribution to business success. ISM Asia No. 1 is an independent research conducted by Syncopate an international market research company, to determine Saiss most preferred brand of healthy lifes tyle products. The study found ISM to e a leading international brand with a strong presence in its key markets. The value reflected the brands ability to deliver a compelling and consistent experience that was relevant to its customers. Its superior brand image is clearly shown in Figure 3 (refer to Appendix 9. 3). 5. Vern Strategic Capabilities as a Basis of Competitive Advantage A firm achieves sustainable competitive advantage when the implemented value creating strategy is not similar to the strategies of current or potential competitors, and benefits of this strategy are not easily replicated by competitors (Barney 1991). In order to understand sources of sustainable nominative advantage, the value chain of ISM is considered in the diagnosis of its strategic capabilities. . 4. 1 V- value of Strategic Capabilities Considering the primary activity (marketing and sales), and support activities (technology development and human resource management) of ISM value chain in Figure 4 (refer to Appendix 9. 4), these capabilities provide the exploitation of opportunities and neutralist threats. Technology development, such as Isms in-house team enables the Group to enhance its R competencies to provide greater value-add t o its business and greater input to the design of its products. According to COBS (201 0), ISM has been actively adding its product range by renewing its product line by up to 25% every six month to cater to the changing needs of consumers. In addition, Isms message of We focus on attracting and grooming great talent committed to our companys goals (Temporal 2006) has proven that its human resource is seen as providing potential competitive advantage. It supports the notion of Happy staff, happy customers through providing training and development. In terms of marketing and sales, ISM has an extensive point-of-sales network and geographical coverage in their markets (refer to Appendix 9. Whereby consumers are made aware of their products and are able to purchase it. 5. 4. 2 R-rarity of Strategic Capabilities Rare capabilities are those possessed uniquely by one organization or by a few others. ISM has worldwide technology patents that give it advantage. For example, Isms patented Music-Synchronized Massage technology and patented ISM Human-AD mas sage programmer which are designed together with its massage chairs. Andrea and Cobra (1996) argued that rarity provides competitive advantage if it meets customer needs, and are of value to them. The convenience of the mobile app technology on its massage hairs has significantly eased the control and transformed into an intelligent, multi-sensory enjoyment for consumers. In summary, ISM has a number of strategic capabilities that are valuable and rare. However, it is not difficult for competitors to imitate the tangible resources of ISM as these can be acquired or imitated over time, and the risks of its product and service substitution are relatively high given the increasing demand for sophisticated and healthy lifestyle. ISM needs to develop products that are inimitable and non-substitutable to increase its bases of sustainable competitive advantage. 6. Business Strategy There are three generic types Of business strategies; cost-leadership, differentiation and focus strategies, with cost-focus and differentiation-focus strategies as subsets of focus strategy (Johnson, Whetting and Schools 201 1). The strategies that ISM is implementing are identified to be differentiation-focus strategies, which refer to the focus on the specialization of creating valuable good and services to answer specific needs of consumers in order to achieve price premium. MM, being the pioneer in the healthy lifestyle industry, focuses on bringing the lifestyle of well-being to their customers (MUM 2007). As a result, the numbers of ISM outlets have continuously grown in many shopping malls. ISM maintains strong relationships with shopping mall owners such as Capitalist and Nameplate in order to be invited as a tenant in their newly opened malls (COBS 2010). Their continuous expansion plans have evidently shown their focus on bringing the lifestyle of well-being to consumers through extensive presence in most shopping malls. In addition, in comparison to Isms competitors such as TOT Boatyard and Gawk, Isms focus on their customers well-being is their differentiating factor amongst other healthcare products providers. Isms continuous innovation and growth has exemplified their mission of delivering well-being to their customers. It couples innovation with passion to drive steady growths and continuous product launches in order to promote positivist to their customers and providing them with the ultimate product usage experience (ISM 2007). In contrast, TOT Boatyard (2011) focuses on using innovation to produce products at low cost to reach out to consumers with right pricing strategies and Gawk (2007) concentrates on producing quality products. Isms usage of innovation is more inclined to producing valuable products hat cater to the healthcare needs of consumers. Another source of focus differentiation originates from Isms commitment to RD to develop their products. Nations Matrix serves as a good strategic management approach for improving competitiveness (Taylor 2012). With reference to Figure 5 (refer to Appendix 9. 5), Isms incorporation of technology and product development has led to the creation of new products for existing markets. Continuous launches of new products via RD innovations to existing markets serve as a defensive strategy to retain customers (Koch 2008). 7. Suitability of Isms Business Strategy Strategy evaluation is an appraisal of how well a business performs. As the environment changes, companies need to alter their strategies to adapt to the environment in order to prosper (Miller 1988). An external environmental analysis and internal capability evaluation has been carried out to determine Isms strategic position, and the suitability of each strategic choice is evaluated in terms of the environment and its capabilities (Table 1 and 2; refer to Appendix 9. 6 and 9. 7). It is clear that Isms competitive strategy (differentiation focus), strategy direction (product development), and ethos of pursuing strategies (acquisitions and alliances shown in Figure 6; Appendix 9. 8) work together as a package. ISM is in a favorable position within its industry given its first-mover advantage, and its strategic option of product development has proved to provide a basis of competitive advantage by reducing competitive intensity and development of barriers to new entrants. It has leveraged on its in-house RD team which is considered as one Of its strategic capabilities to deliver differentiation benefits as valued by its consumers. In addition, ISM has adapted to its environment by exploiting n the opportunity that consumers are trending towards a healthy and positive lifestyle.

Customer and Double Essay examples
Customer and Double Essay examples Customer and Double Essay examples Week 1 ââ¬â Accounts Receivable/Payable This is my first week interning at Double J Trailer Sales. Double J Trailers is one of the largest horse trailer dealerships on the west coast and has the largest bumper pull trailer selection in the Northwest. This first week I decided to write about accounts payable and receivable. For accounts payable, payable are managed by being entered when the bill comes in, and then bills are paid twice a month, the 15th and 30th. Receivables are entered when trailers or parts are sold and money is deposited daily. This week I used QuickBooks to create invoices for sold trailers. Invoices are created to bill the customer for the product and service they receive and also for Double Jââ¬â¢s records. When the customer pays the invoice, I also use QuickBooks to receive and record the payment. Iââ¬â¢ve learned how to use QuickBooks a little throughout my internship, but I wish there was a class at Western that could teach me more about it. QuickBooks is a great way for Double J to stay organized and seems like a great program. The only problem is that there is too much work for one person and the only improvement Tammy suggested was to hire another employee. Week 2 ââ¬â Bookkeeping QuickBooks is used for bookkeeping and record keeping. This week Tammy showed me a lot about QuickBooks and had me reconcile the Double J credit card for her. She taught me that reconciling credit cards is important for keeping accurate records and tax returns. It can also help track where the money is being spent by putting each transaction into different accounts such as: supplies, meals and entertainment, tools, and auto expenses. The technique for keeping important documents safe is by filing them in a fire safe drawer. An example of a document that is kept in one of these drawers is the ââ¬Ëbill of saleââ¬â¢ for a trailer. This week I learned how to write up a bill of sale. I wrote one for a customer who was buying a used trailer with a rotten floor and one of the important things I had to do was write a disclosure saying that the customer knew he was buying a trailer with a rotten floor and then I had him sign it. Backups of the bookkeeperââ¬â¢s computer are done on a zip drive every night. The system using QuickBooks works well because it is always updated to the latest version. According to Tammy, no improvements are needed. I would agree with that statement except I think Tammy has too big of a work load at Double J so the only improvement would to maybe hire a part time bookkeeper just to take some of the stress off of Tammy. Week 3 - Customer Service Double J Trailers is a small family ran business. Because of its size, I think people are very happy with the customer service they receive when they come into the store. Wayne and Tammy are very friendly people so they usually make good relationships with their customers. This is a very good thing because if customers are happy with the product and service they receive from Double J, then they may tell their friends about the company, generating more business for Double J. Since Double J is a small business and hires only a few employees, there is no real training of customer service; itââ¬â¢s more of a watch and learn kind of thing. But the boss does have high expectations for customer service so you better watch and learn well. I actually received many compliments from customers and my boss for how well I took care of customers over the phone. At Double J, there arenââ¬â¢t many complaints or conflicts with customers. However, I have received complaints over the phone about Wayne not responding to customers over phone or email in a timely matter. Since Wayne is the boss and usually very busy, the only way I deal with these complaints is assuring the customer that I will have Wayne call/email them as quickly as possible. I then pass the message to Wayne that he may lose business if he does not call that certain customer back soon. Besides that, the

CHAMBLEE v. GRAYCO, INC Case Study Example | Topics and Well Written Essays - 1250 words
CHAMBLEE v. GRAYCO, INC - Case Study Example Rules Premise liability is concerned with the claims of one party (the tenant) against another party (the owner) on the ground of getting injured in the property. It has been noted that in such cases the injured person can claim against the owner or the controller or the occupier of the property as per the tort law. Consequently, the owner, the controller or the occupier of the property, whoever is responsible to maintain the property, will possess the same liability under the premise liability law. In this case, the law of Georgia will be taken into concern. According to the section 51-3-1 of the Georgia premise liability law, an owner or occupier or controller of any property is liable to perform the duty for keeping the premise safe and free from any sort of physical danger for the people who visit the place. However, this section of the law also states that the occupier or the owner of the property is not an insurer of the safety of the people visiting the property. Furthermore, the invitee or the visitor should also take some extra care so that he/she can avoid unreasonable injuries or harm as mentioned under section 51ââ¬â11ââ¬â7 of the premise liability law of Georgia. ... This resulted in serious injuries to the plaintiff, following which she sued the defendant (i.e. the landlord) on the ground that the premise was not safe and it was clearly a case of negligence. As per the plaintiffââ¬â¢s complaints, the owner of the property, i.e. Grayco had not paid adequate attention towards the duty of ensuring a safe premise for the tenants of visitors of the property. On presenting the case to the court, the evidences revealed that Chamblee was entirely responsible for the change in route and also for her damages. Hence, the courtââ¬â¢s decision affirmed that Chamblee had not been responsible enough to avoid the accident. The normal route that she uses to take every day was safe enough. Therefore, the responsibility of the landlord is justified by this aspect. Further evidences suggest that Chamblee took that route owing to certain personal reasons which was irrelevant for the case. According to section 51ââ¬â11ââ¬â7 of premise law of Georgia, in vitees or tenants will be entirely responsible for any sort of injury caused due to their conduct under the similar circumstances as witnessed in the case of Chamblee v. Grayco, Inc. Furthermore, the law also suggests that invitee(s) will need to be careful about their own well being when entering a property. Contextually, the responsibility of the resident(s) or the owner(s) in maintaining a safe pathway is confined to the regular entrance and exit points. Apparently, this aspect does not support Chamblee in this case. A similar scenario can be illustrated with reference to the case of Bartlett v. Mcdonough Bedding Company. Furthermore, analysis of evidences depicted that the

How does your research into Customer Relationship Marketing confirm or Essay
How does your research into Customer Relationship Marketing confirm or contradict this statement - Essay Example This paper demonstrates that all the aspects have a great bearing in establishing customer relationships through marketing and sales. Considering these aspects and studying its components comprehensively will give an organization an edge on formulizing and strategizing an approach to the market it targets in general. Offensive marketing is a strategy used to generate more revenue or acquiring new customers and sales. On the other hand, relationship marketing focuses more on retention. Marketing strategies like this are commonly used for acquisition and retention of customers. It is important for the company to generate more revenue by getting new customers and in the process have a larger share in the market. Maintaining and keeping these customers loyal is another story. This is why, we have to study the market we want to target. This is because business to business relationships and end users or consumer relationships, should have different experiences. A divided number of percenta ge in the end user market has their own unique needs. This goes for organizational and business needs as well. Having this as a fact, relationship marketing and management should be diverse and flexible in order to meet standards and needs of every unique customer. Relationship marketing and its management starts from the acquisition of new customers, or one time purchase transactions. It is important for an organization to know the differences and similarities in the buying behaviour in order to accommodate this one time or first-time transactions.
Conley vs.wilmut Essay Example | Topics and Well Written Essays - 750 words
Conley vs.wilmut - Essay Example Conley stance is harsh and firm: human cloning should not be practiced because it interferes with Godââ¬â¢s creation. Conversely, Professor Ian Wilmut is polite and puts himself on the hot seat to defend the practice. He remains objective and asks tough questions such as, if couples have been denied the right to procreate naturally, what is the harm in trying out new technology like human cloning (Wilmut, 2004). The topic on human cloning has brushed shoulders with high political icons and religious leaders. The ethical part has hit many headlines in the media world and raised eyebrows as to its interference with the natural process of human creation. Wilmut has remained extremely aggressive and has an ego driven attitude towards the whole process and the perception on human cloning (Conley, 1994). Human reproduction has occurred naturally since the dawn of time. However, with current advancements in technology and research, the potential for this to change is very high. Conley has done well to address the burning issue and has made great strides in evaluating the challenges that couples face when they are unable to conceive and bear (Conley, 1994) With his deep-rooted Roman Catholic beliefs, Conley remains a close-minded voice as to the effects of human cloning. Wilmut, on the other hand, is set on killing the stigma. Research has been done in hopes of solving some of these issues. Couples have been genetically challenged to have the right to live a life like any other normal human being (Wilmut, 2004). The pervasiveness of this discourse concerningà the dignity inà todayââ¬â¢s world hasà givenà it a mask of the subject matter that has beenà highlyà contested andà made it vague. Wilmut has observed this in his sixth edition; this concept has become ubiquitous. Conley has claimed that cloning of human embryos has violated the sanctity of the human race. He recommends that it should not be

Discuss the ethics of euthanasia Essay Example | Topics and Well Written Essays - 500 words
Discuss the ethics of euthanasia - Essay Example This concept of mercy killing has always been a bone of contention in the society. The notion that one is allowed to simply take their or someone elseââ¬â¢s life just because they are in pain then the value of life is meaningless. It is believed that if someone is meant to die then they will die if not, then it is our responsibility to ensure that they live for as long as possible. There is a big difference between letting someone die and killing them. Euthanasia gives people the impression that it is okay to relieve yourself of life because the suffering has become too great. In some cases however, the turnout of some events are beyond our control. Some patients go to hospitals in great pain but they are so willing to die that one can do nothing to help their situation. When a patient, for instance, refuses to take their medication and insist on doing away with all the burdensome medical procedures, they are bound to die. However, the doctors cannot be blamed for mercy killing in this case because the patient was difficult. The doctrine of double effect is another occurrence that is usually above the medical staff control that people confuse with euthanasia (Keown, 23). When a person is administered to drugs they are meant to help them get better. This is the common knowledge of how hospitals operate that people are familiar with. However, this is not all true since there are some cases that the doctor might administer medication that help manage side effects of diseases but also cause the patients statues to degrade. This is what is known as the doctrine of double effect. In an accident scenario, a doctor might try to relieve the pain of a victim using a drug that might cause their liver to shut down in the process killing them. However, this person will not die painfully but gracefully slip to oblivion. To most people, the thought of taking a life is something that should not even be put into discussion. While most cultures are very

Banking Regulatory reforms Essay Example | Topics and Well Written Essays - 1500 words
Banking Regulatory reforms - Essay Example A few months later, the Franklin National Bank of New York had to shut their operations due to substantial foreign exchange losses. The turmoil in the financial sector prompted the governors of the central banks of G10 countries to decide upon measures on Banking Regulations and Supervisory Practices. Later, this came to be known as the Basel Committee on Banking Supervision with a purpose to extend cooperation among its member countries in the matters related to banking supervision. Initial objectives were to set minimum supervisory standards; exchange information on supervisory practices and improve the techniques of supervision on their banking system. The Central banks of the each member country represent their countries in the committee. It must be noted that the committee's decision has no legal bearing. The committee formulates standards and recommends them to their member countries for its implementation. The committee's sole aim is to have common standards for regulatory and adequacy measures. The 1988 accord among the member countries, with regard to the regulation and supervision of banking sector, continued until 1999 when the Committee decided to further improve the capital adequacy framework. Current Regime under Basel II The revised capital framework came into force in 2004 called Basel II. The Basel II was aimed at creating an international standard for regulators to decide upon how much capital the banks must have to safeguard themselves in the event of any financial crisis. Sufficient consistency of regulations was focused at to ensure that this does not become a reason of competitive inequality for some of them. Their advocates believed that such a regulatory framework is needed to prevent failure of banking system should such crisis emerge in the future (Basel Committee on Banking Supervision, 2013). Basel II, in theory at least, attempted to set up capital and risk management requirements so that banking failures could be avoided. For this, Basel II created disclosure requirements so that all market participants could know about the capital adequacy of a financial institution. They also ensured that market risk, credit risk, and operational risk are articulated based on available data. Basel II focused on minimum capital requirements, market discipline and adequate supervision (Basel Committee on Banking Supervision, 2013). Though Basel II regulatory measures were in force yet it could not prevent 2008 international financial crisis. Post 2008 crisis, the Central banks came out pointing various reasons of financial failures and about the weaknesses that existed in Basel II accord. An urgent need was felt by all concerned to address weaknesses in Basel II. That is why the Basal committee on banking supervision decided to create a new comprehensive accord that could further reform and address the issues that were instrumental in causing the 2008 financial crisis (Basel Committee on Banking Supervision, 2013). It will be interesting to see how Islamic banks, in the context of Basel II manage the capital adequacy and risk exposures. Islamic banks do not use money markets and that is why they are susceptible to liquidity risks. Their inability to borrow for short-term fund needs make them vulnerable to market fallouts. The situation necessitates that Islamic banks must maintain higher liquidity than any conventional banks. Basel
The Cases of Hirabayashi and Korematsu v United States Essay Example for Free
The Cases of Hirabayashi and Korematsu v United States Essay The United States, after the fatal attack of the Japanese in Pearl Harbor on December 7, 1941, was forced to enter World War II. There were a few of Japanese descent who, due to the immigration that begun since before 1885, were in the mainland America. Many feared what these Japanese-Americans would side on their home country of Japan that would possibly lead to a successful invasion of Japan. The fact that Japan has invaded one after another Pacific island where American forces were based did not help the public opinion of many regarding the Japanese on the United States. As a precautionary measure, President Franklin D. Roosevelt has enacted two executive orders to prevent incidents of subversions and espionage from Japanese-Americans. Two Japanese-Americans were found to be guilty of violating these laws which has ultimately brought their cases to the United States Supreme Court. On February 13, 1942, Roosevelt signed Executive Order 9066 which defined military areas in the United States and authorized the removal of Japanese-Americans within these military areas. The Order declared that ââ¬Å"the successful execution of the war requires every possible protection against espionage and against sabotage to national defense-material, national-defense premises, and national-defense utilitiesâ⬠(United States Supreme Court [USSC], 1944). It also provided assembly centers for those who will ultimately be transferred to evacuation camps. As a result, approximately 120,000 Japanese-Americans were in internment camps (Schaefer, 2008). While the evacuation carried out with little difficulty, there were those who militantly defied the order. The Japanese American Citizens League, an organization founded in 1924, hoped that cooperating with the American decision will lead to sympathetic consideration when the tension subsided. Of those who resisted the order was Toyosaburo Korematsu. Korematsu was a US-born Japanese-American who stayed in San Leandro, California and knowingly violated the Civilian Exclusion Order No. 34ââ¬âan order based upon the provisions of Executive Order 9066. The Civilian Exclusion Order No. 34, an order issued by the Commanding General of the Western Command, directed that ââ¬Å"all persons of Japanese ancestry should be excludedâ⬠from San Leandro, California (USSC, 1944). Korematsu was arrested and was found guilty of the violation. He challenged the constitutionality of the Order and held that it is in violation of the provision in the Fifth Amendment stating that no person shall ââ¬Å"be deprived of life, liberty, or property without due process of law, nor shall private property be taken for public use, without just compensation. â⬠The question of loyalty was not raised. Furthermore, the evacuees were forced, charged with no crime and could not leave without official approval (Schaefer, 2008). This is crucial in that, as Schaefer explained, the Japanese-Americans that were forced to resettle in evacuation camps were instructed that they were to carry only personal items. ââ¬Å"No provision was made for shipping their household goodsâ⬠and ââ¬Å"the federal government took a few steps to safeguard their belongings they left behindâ⬠(Schaefer, 2008). The Court (1944) decided that the need to protect against espionage from persons of enemy descent, of Japanese descent in Korematsuââ¬â¢s case, far outweighs their rights as provided for by the Fifth Amendment. The Court held that the military authorities were charged with the protection of the American soils. Furthermore, the Civilian Exclusion Order is in accordance to the provisions of the Congressional authority to the military allowing them to identify who should and who should not remain in areas threatened with invasion, espionage or sabotage. The court explained that they have no doubts that most of the evacuees were loyal to the United States. They reasoned that the exclusion of the entire Japanese-American population was brought upon the contention that the disloyal could not be immediately segregated from those who are loyal to the United States. The Court (1944) explained ââ¬Å"that there were members of the group who retained loyalties to Japan,â⬠a fact that ââ¬Å"has been confirmed by investigations made subsequent to the exclusion. â⬠It has been found that ââ¬Å"approximately five thousand American citizens of Japanese ancestry refused to swear unqualified allegiance to the United States and to renounce allegiance to the Japanese Emperor, and several thousand evacuees requested repatriation to Japanâ⬠(USSC, 1944). While the Court (1944) held that compulsory exclusion of large groups of citizens from their homes is inconsistent with basic governmental institutions, ââ¬Å"when under conditions of modern warfare our shores are threatened by hostile forces, the power to protect must be commensurate with the threatened danger. â⬠Finally, the Court (1944) explained that ââ¬Å"Korematsu was not excluded from the Military Area because of hostility to him or his race. He was excluded because we are at war with the Japanese Empire, because the properly constituted military authorities feared an invasion of our West Coast and felt constrained to take proper security measures, because they decided that the military urgency of the situation demanded that all citizens of Japanese ancestry be segregated from the West Coast temporarily, and finally, because Congress, reposing its confidence in this time of war in our military leaders-as inevitably it must-determined that they should have the power to do just thisâ⬠Another case wherein a Japanese-American has challenged the United States government, particularly of its military institution, was the case of Kiyoshi Hirabayashi v United States. This time, the guilty was found to be violating the Act of Congress of March 21, 1942 requiring all persons of Japanese ancestry to be in their place of residence between 8:00pm to 6:00am. The Act was also in accordance to Executive Order 9066. The Courtââ¬â¢s ruling was also in favor of the United States. While the Hirabayashi case was earlier decided, it has been greatly overshadowed by the Korematsu case due to the fact that exclusion was more extreme than that of the curfew rule. However, the Supreme Court decision made on the Korematsu case relied and affirmed the decision in the Hirabayahi case. Korematsu and Hirabayashi both challenged the constitutionality of the rules enacted based on Executive Order 9066. They claimed that the rules violated the provisions of the Fifth Amendment stating that no person shall be deprived of life, liberty or property without due process of lawââ¬âa provision that was violated when the military institution has apprehended Korematsu and Hirabayashi and all other Japanese-Americans without questioning and even the indication of treason or disloyalty to the United States government. Unsurprisingly, the United States Supreme Court ruled in favor of the federal government, giving precaution for espionage and sabotage from persons of enemy descent during the time of war as a justification for such rules imposed based on Executive Order 9066. They held that the rules were not insomuch as a racial prejudice against citizens of Japanese ancestry but was necessary for the war efforts to be successful. The Court, however, clarified that the rules based on the Order should only be imposed until such time when the war is over. The Japanese-Americans lost much of their property and were destroyed economically. After World War II, the United States federal government paid $35 million to the Japanese-Americans who were affected to compensate for the loss of property. However, the total loss was estimated to be worth up to $400 million. References Schaefer, R. (2008). ââ¬Å"Japanese Americans. â⬠In Racial and Ethnic Groups 11th Edition. The Humor In Friends
The Humor In Friends Friends is the famous sitcom in the United States which was played at the NBC television since the 1990s. After entering the Chinese film market, The TV sitcom also have given Chinas TV viewers a new feeling, and attracted many fans of it. As one of the most popular sitcoms in the United States, Friends has been successfully completed 10 seasons. And more than 60 countries have its loyal audience. But, when the film was playing, I fount that most of the people seemed by no means to had laughed as might as perhaps had been anticipated in canned laughter. To explore the reason is people are unable to understand the humor of it. So they dont laugh. Therefore, this essay attempts to explore humor of Friends through the use of relevant theory and research. Definition and Classification of Humor Humor derived from the Latin whose original meaning is body fluid. And the extensive use of humorous is attribute to the British playwright whose name is Ben Jonson. The Every Man in His Humor which is created by him is remarkable for humor. Humor is a form of languages which through the art of processing and it is artistic language. Definition of Humor French writer named Degebola had given a definition of humor: Humor is an element in peoples laugh. Humor is what moves us. Humor is a smile in the eyes of wise man. This is a happy idea of an unsophisticated person. In fact, it is very hard to give a definition of humor for it belongs to a genius and inspiration. Humor will use the glows of wisdom to rout of the dark of life, and create the beaming smile. Lenin had said that: Humor is a beautiful, healthy quality. Maybe this is why some people have sense of humor as a manifestation of a persons maturity. So humor is the great wisdom, which is the ridicule and naughty after apperceive life. And this will be my definition of humor. Common Classification of Humor From the form of points, humor mainly including these types as followed: Transform Humor means to agree with this point firstly, and then worsened, and point out the different point of view. This humor can make both sides of this antagonism freed from the confrontation, and create a relaxed atmosphere. Lets take an example: Huxley actively supported and promoted Darwins theory of evolution, for which he had been cursed as Darwins bulldog by the church at that time. A debate, when Huxley went into the meeting, the religious leaders and some people who against the theory of evolution were shouting: Be careful, Darwins bulldog comes again! Huxley wasnt angry, and then he said to the detractors contemptuously: Yes, you are right. But the hounds are the most fearsome things of thieves! As a result, the attackers got much unhappiness, but Huxley and his supporters kept calm and happy. The character of Transform Humor is the objection after agreement, and it clarify their own point of view unexpectedly with the purpose to enable readers to understand thats witty sense of humor. Self-mockery Humor means that others tease you intentionally or unintentionally to send you into a dilemma, and then you can use the Self-mockery Humor to disengage yourself from adversity decently. Rockefeller who was the U.S. oil magnate was a little bald. Once at a public occasion, one of his opponents in a sarcastic tone said to him: Sir, you have made combing into an art form, because you have made an arrangement for every hair of your head! With a wry smile, Rockefeller said: In the past years, they are just a number. But now they both have their own names. Everybody got into laugh, and Rockefeller was also able to escape the predicament quickly. A real sense of humor is inseparable from self-involvement, which gives the humor to others, but also to themselves. People who lack of self-confidence can not humor himself. Therefore, the Self-mockery Humor is more need for self-confidence. Distortion Humor means the listener dont understand the meaning of each other, but apprehend from another aspect intentionally. And bring a sense of humor to make people laugh. Lets take an example to explain. Teacher: I hope all of students parents will come to attend on the parent-teacher meeting this Friday. Student: Excuse me, sir. Which should we call to take part in, farther or mother? Teacher: Its not important. Ask the person who is the head of a household to come. Student: That had to be me. The object that the teacher pointed was parents. But the student interpreted it as member of family. So, of course, he included himself. Distortion Humor is often expressed in the form of pun, similar sound and ambiguity. Sophistry Humor. Hegel once discussed sophistry like this: Sophistry usually means to make a false truth very nice, which like the real thing. Sophistry Humor means to make humor in a sophistic way. Of course, it should make sophistry emotional and extreme. Because it is the only way to make sophistry integrates with humor. Emotionality means to inject joking and ridicule factors into Sophistry. Extreme can make a person know it is false immediately, which avoid deceptive and damaging. Sophistry Humor is not the same as Sophistry Logic. Sophistry Humor let you see the flaws deliberately, and realize the humor in it. For example: The teacher discovered that Peter was sleeping in the class. Then she asked: Why do you sleep at class, Peter? Peter: Im not sleeping. Teacher: Why do you close your eyes? Peter: Teacher, I was reciting the concept. Teacher: Why do you nod you head all the time? Peter: Because your class is very nice, sir. Teacher: Why do you drool? Peter: Because it is full of relish in your class. Peter was sleeping in the class, but he refused to acknowledge. The words that he answered the teacher were all false, which like Hegel said: It is very nice, and like the real thing. The Humor Used in Friends Universal Humor means the way of humor which make different cognitive environment of readers understand easily. For example: Phoebe: Yeah. We dont speak. Shes like this high-poweredà ¼Ã
âdriven career type. Chandler: What does she do? Phoebe: Shes a waitress. (Season 1:2) In this dialog the waitress does not like her twin sister clearly. First, the description of her sister makes the audience think of a high occupation immediately. But as the dialogue progresses, the audience know she is a waitress. Two kinds of script opposition (high / low status) make them have to understand the text again, and this processing has also got more contextual effects. Cultural Humor. Such humorous use the elements of knowledge which should be understood under a particular cultural context. In sitcom, it is often to use some movie stars or the name of a classic novel to get humorous effects. Therefore, the focus of such a translation is that we must notice whether the audience can understand the original knowledge and do some necessary adjustments before translation. Or it must result in failure. For example: Monica: Oh waità ¼Ã
âyou know whatà ¼Ã
âI got ità ¼Ã
âI got ità ¼Ã
âpretend like you just woke upà ¼Ã
âokayà ¼Ã
âthat will throw her off. Be sleepy. Rachel: Yesà ¼Ã
âand grumpy. Chandler: What are youà ¼Ã
âstop naming dwarves!à ¼Ãâ Season3:4à ¼Ã¢â¬ ° Snow White and the Seven Dwarfs is well-known story in the West. Sleepy and Grumpy are two of the small dwarfs names. Chandlers reply gives an additional contextual effect to the recipients. But in China, the more familiar calling is the first dwarf, the second dwarf, and the third And the Chinese audiences are unable to obtain the names of the dwarfs. The translation make interpreter pay more efforts, but received little of the contextual effects. So it is failure. Verbal Humor. Language humor (or named pun) is a word game to strive to achieve a humorous effect. When the two scripts appear in a scene simultaneously, they may be overlap or completely overlap, but the meaning must be opposed in certain degree. In translation, due to the coincidence of language, puns can also be reflected perfectly in the translated version by the way of literal translation. For example: 1)Joey: AHà ¼Ã
ânow Rachelà ¼Ã
âthese ahà ¼Ã
âthese little women. Rachel: Yeah. Joey: How little are they? I meanà ¼Ã
âare they like scary little? (Season 3:13) Joy is going to read Little women which is recommended by Rachel. But he still comprehends in wrong way for his little reading. 2)Phoebe: Wellà ¼Ã
âI-I wasnt hopping madà ¼Ã
âyou know. Frank: You hopped a little bit. (Season 3:5) Hop means light jumping. But the meaning of the text is very angry. This translation is very successful. However, such a language is rare and more of the status as flowed: 3) Phoebe: Oh. (They start kissing again) Ross :Waità ¼Ã
âwaità ¼Ã
âwait. Phoebe: What? Ross: My foot is stuck in the pocket. Phoebe: What? Ross: Noà ¼Ã
âI cant get it out. Phoebe: Wellà ¼Ã
âthats not something a girl wants to hear. Ross: Noà ¼Ã
âcome on dont start. (They start kissing again) Ouch! Phoebe: What? Ross: Stupid balls are in the way. (Holds up two balls)(Season 3:6) In this event, the translators can adjust at all levels to make the translation as similar as original interpretation. Humor Translation Theories Through the comparison of humor used in common environment and Friends, we know that humor can roughly be divided into the following two kinds of humor theory. General Theory of Verbal Humor The General Theory of Verbal Humor (GTVH) proposed by Victor Raskin and Salvatore Attardo in 1991 (an extension of the semantic script theory of humour, SSTH which Raskin proposed in 1985) identifies a semantic model capable of expressing incongruities between semantic scripts in verbal humor; this has been seen as an important recent development in the theory of laughter. The GTVH is one of the most mature theories which research the humor of language from linguistic humor. GYVH proposed the humor mechanism which is mad up by script oppo-sition, logical mechanism, situatio, target, narrativestrategy and language. Oppo-sition can be interpreted as overlapping and opposition of two or more of the script. Logical mechanism would mean that only works in a joke. Distorted and joking logic means the logical mechanism of combine two or more scripts. Situatio is the various props of joke: people, events and things. Target means the laughing-stock in humor. Narrativestrategy indicates that any sense of humor will adopt some sort of narrative techniques, such as general narration, dialogue, puzzles and so on. Language contains all the needed information and specific wording the text of the oral language of the text. Attardo think that the most important element of knowledge is that the inconsistent script which has determined the specific choices of other elements. So he point out that any humorous text must contain this factor. He also pointed out that when two humorous compare, the levels higher, the same less. (Attardo, 1994:183) So it is also a tool to compare the similarity of humorous. Relevant Theory of Humor Translation Relevance theory is used mainly to understand the problem and describe discourse. In the view of its founders Sperber and Wilson, the context in discourse comprehension is a very important factor. They suggest that it is necessary to understand the words in context. And its only need to activate in certain aspects of the context, but not all. The building of context doesnt progress in the bound of mutual knowledge for understanding the discourse, but try their best to build their own context to become communion. When people affiliating with each other, they continue to correspond and compromise, and be in accord at last. Relevance theory suggests that here are generally three situations about complementarity and expansion for interlocutors to cognize context: The first is encyclopedic knowledge in context, which the listeners add some necessary encyclopedic knowledge to expand their understanding context in their existing cognitive context. The second is context of knowledge. It means that the listeners can transfer related information from the short-term memory which provided by above text to expand their understanding of the context. The last is situational knowledge in context. It means that the listener must call the relevant information from the surrounding scene to expand their understanding of the context. When translating the universal humor, its important for readers to gain more contextual effects through the process of seeking the opposite script to pay extra effort. When translating the cultural humor, the translator should pay attention to that if the readers knowledge can understand the elements in the text. When translating the verbal humor, the translator can do some flexible adjustments within the allowable range. Analysis of Humor in Friends dialogues Through the above descriptions and argumentations between common humor and the humor in Friends, the following we will make a detailed analysis of the humorous dialogues in Friends. There are a large number of humorous dialogues in Friends. But not all these dialogues can be used in this paper. So, the humorous dialogue needs to be created in accordance with factors or the reasons for creating humor. Those that flout three maxims were chosen to be explained in details. Humor Produced by the Deliberate Flout of the Maxim of Quality By the maxim of quality, it means that in a dialogue we all make our contribution to one thing that is true or say things that are true. To keep to this maxim, we simultaneously observe two sub-maxims: we do not say what we believe to be false, and we do not say anything we lack adequate evidence. Joey: What are you talking about? Keep it! Phoebe: Its not mine, I didnt earn it. If I kept it, it would be like stealing. Rachel: Yeah, but if you spent it, it would be like shopping! Phoebe: Okay. Okay, lets say I bought a really great pair of shoes. Do you know what Id hear, with every step I took? Not-mine. Not-mine. Not-mine. And even if I was happy, okay, and, and skipping-Not-not-mine, not-not-mine, not-not-mine, not-not-mineà ¢Ã¢â ¬Ã ¦Ã ¢Ã¢â ¬Ã ¦(Friends, 1994) This dialogue appears in this scene that Phoebe find there is 500 extra dollars appeared in her account. And every one advises her to keep the money, but she is unwilling. She wants to use them to buy something. She believes that if she used the money to buy shoes, shoes would blame her. Of course, she knows shoes can say nothing. She is saying something untrue and is thus flouting the maxim of Quality. At the same time, humor is produced by the shoes which are personified as a person having a voice. Her implied message is I should not keep the extra money. And I would feel guilty if I kept and used it. 2)Ross: Yeah, uhà ¢Ã¢â ¬Ã ¦ and then I figured after you win, we could all go out to the balcony and see a night rainbow with gremlins dancing on top of it! Ross: You know what, Im sure your wish is gonna come true, but, you guys-just in case, maybe a genie will come out if we rub this lamp! (Friends, 1999) Ross said that these two sentences, meaning that compare with his friends words someone see a night rainbow with gremlins dancing on top of It, the words a genie will come out if we rub this lamp is more convinced, to show he does not believe his friends would win. The humor here is expressed through the use of metaphor. Ross knows that it is hardly happen for the phenomenon what he said, so he is flouting the maxim of quality deliberately. The implicature that results is It is impossible for you to win. 3) Ross: If I hadnt let you talk me to go into the airport in the first place, I wouldnt have put my fist through the wall. Chandler: You put your fist through the wall? Ross: No. I miss it and hit the door. But it opened really hard. (Friends, 1997) Ross fails to persuade his girlfriend to stay with him. He says he put his fist through the wall to show how upset and angry he is. But, what Ross said is doubted by Chandler because Chandler knows Ross is too timid to put his fist through the wall. Last, Ross admits he just put his fist on the door. Here, the untrue words which said by Ross on purpose and so it flout the maxim of quality. This kind of humor is founded on hyperbole largely. Humor Produced by the Deliberate Flout of the Maxim of Relevance The maxim of relevance means that we make all of contribution relevant to the exchange in a dialogue. 1à ¼Ã¢â¬ °Ross: So, I just finished this fascinating book. By the year 2030, therell be computers that can carry out the same amount of functions as an actual human brain. So theoretically you could download tour thoughts and memories into this computer and and and live forever as a machine. Chandler: And I just realized I could sleep with my eyes open. (Friends, 1995) Although Ross and Chandler are good friends, they are worried about different things due to their differences in character. When Ross is talking about high-tech, Chandler talks about sleeping with eye open in response. His reaction has nothing to do with the subject of Ross. Therefore, he is flouting the maxim of Relation. It is easy for audience to understand his sense of humor. That the subtext is: Im not interested in your topic. 2à ¼Ã¢â¬ °Ross: I can ask her to live with me. Chandler: Are you serious? Ross: Why not? Chandler: Because youve only known her for six weeks. Ive got a carton of milk in my fridge, and Ive had a longer relationship with. Ross: Look, guys, I love her, you know? (Friends, 2001) Chandler: And I love the milk! But I wont ask some British girl to move in with me! Ross wants to ask his British Girlfriend to live with him. But Chandler disagrees. He thinks it is too short for them to live together. And this is reasonable. Later, he refers to the milk which is in his fridge. Chandler compares the time that he keeps the milk in fridge with the time that Ross knows his girlfriend. It is clear that there are no comparable kinds. Obviously, the thing said by Chandler is irrelevant to the matter of Ross. Thus humor is produced by his flouting the maxim of Relevance. Phoebe: Oh, hey, Mon, do you still have your like old blouses and dresses from high school? Monica: Yeah, I think I have some around here somewhere. Why? Phoebe: Well, its just that maternity clothes are so expensive. (Friends, 2003) In this conversation, when Phoebe is asked why she talks about Monicas dresses from high school, she answers maternity clothes are expensive which does not seem to answer the question. But in fact, she is suggesting that the blouses and dresses of Monica are big enough for a pregnant woman. Thus humor is produced by her flouting the maxim of Relevance deliberately. Humor Produced by the Deliberate Flout of the Maxim of Manner By the maxim of manner, it is meant that in a dialogue we all try to be perspicuous. In line with this maxim, there are four sub-maxims: 1) we try to avoid obscurity, 2) we try to avoid ambiguity, 3) we try to be brief, and 4) we try to be orderly. Phoebe: Ooh! Oh! (She starts to pluck at the air just in front of Ross.) Ross: No, no dont! Stop cleansing my aura! No, just leave my aura alone, okay? Phoebe: Fine! Be murky! (Friends, 1996) In this conversation, Phoebe tries to catch Rosss attention by the way of plucking the air in front of Ross. But Ross feels annoying, and he would like leaving alone. So he said: Stop cleansing my aura! Just leave my aura alone. Moreover, Phoebe doesnt use unhappy to describe the air around Ross directly. She uses murky. Here, both Ross and Phoebe use obscure expression and thus flout the maxim of Manner. But the humorous effect they create and the implicature of their utterance are obvious and accepted by audience. Emily: What did you decide? Does your uncle Nathan get an invitation or not? Ross: Oh, God! Nobody likes him. And hes so cheap. I mean hed never fly to London in a million yearsà ¢Ã¢â ¬Ã ¦ Yeah, invite him. (Friends, 1997) Ross and Emily are deciding attendees for their wedding. When Emily and Ross discuss whether tell Ross uncle to attend the wedding, Ross does not answer yes or no briefly and directly. Instead, he says a lot of weak points of his uncle in the first place, but finally he decides to invite him so quickly. Therefore, it is clear that Ross intentionally express in a long way which create a sense of humor in the way of flouting the maxim of Manner. Chandler: Now it seems like all of a sudden, so much is happening. Joey: I know. Ross is getting married. Chandler: Phoebes making people. Joey: Everybodys doing stuff. Chandler: And we just sit here. I meant if I died, the only people know would be that I was here only by the ass print on the chair! (Friends, 1997) Chandler and Joey have a conversation talking about their recent life. Compared with the friends who are in dealing with some major events, they are wasting their lives. Chandler says these words to create a funny effect, and that is we just sit hereà ¢Ã¢â ¬Ã ¦if I died, the only people know would be t hat I was here only by the ass print on the chair. This sentence could hardly be humorous if he just says directly and briefly we just sit here without doing things meaningful. Therefore, Chandler produces humor by the way of flouting the maxim of Manner. Conclusion This paper discusses some humorous conversations in the U.S. sitcom Friends. Humorous conversation delivers the meaning of a conversation situation in this case. Therefore, this paper, furthermore, is possible to explore the deeper meanings which are implied or hidden in humor. To some extents, this paper can help audiences better understand the method for humor, as well as the expression of humor, in particular, to improve their ability of understanding and using humor of American verbal because the humor in Friends is humor of unique American style. However, the researches in this field have not reached a mature stage, which are quite deficiency and lack of authority both in China and abroad. Because of the differences between different cultures, people in non-English speaking countries do not fully understand the English sense of humor sometimes. Friends is a classical and typical American sitcom which is full of strong elements of American culture. The way of Studying and discussing American culture is a great help for English learners to understand American humor. Therefore, a further study of humor in Friends can possibly make certain contributions for cross-cultural communication. Humorous language, as the main form to express humor, is popular in our daily life. It comes from our daily life while to some degree it goes beyond life reality. Humor is such a pervasive human phenomenon, observable in many aspects of life that it has been studied from a multi-disciplinary viewpoint, including fields like linguistics, rhetoric, aesthetics, philosophy, sociology, and etc. From this essay, detailed and Pragmatic Analysis of Verbal Humor in Friends can help English learners to better improve their ability of understanding and the appreciation of the nature of American humor. At the same time, it is illuminating for them to apply humor skill to mediate interpersonal relationships. References English Language Humor Appreciation. Mao Guirong.
